6.La general implementation of the EEA-EFTA and Swiss agreements linked to them Persons protected by the withdrawal agreement and who have not yet acquired permanent residence rights – if they have not lived in the State of for at least five years – are fully protected by the withdrawal agreement and can continue to reside in the host state and acquire permanent residence rights in the host state, even after the UK`s withdrawal from the EU. The UK has launched the formal process of withdrawal negotiations by formally announcing the European Council`s intention to leave the EU. Under the backstop, the UK will form a customs union with the EU (with the exception of trade in fisheries and aquaculture products, which is expected to be the subject of a new agreement on fishing opportunities by 1 July 2020). The UK will comply with specific EU customs legislation, including for third countries, and some harmonisation of tax, environmental, labour law, state aid, competition and public enterprise/monopoly legislation will continue, but without any obligation to follow the new EU legislation and ECJ jurisprudence. In order to create a level playing field, the UK is committed not to competitiveise EU environmental protection, social and labour standards, state aid and competition, as well as state-owned enterprises in tax management. On 13 November 2018, the EU decided that «decisive progress» had been made in the Brexit negotiations, and on 14 November the European Commission and the UK Government published a draft withdrawal agreement as well as three protocols (on the border between Ireland and Northern Ireland, the SOVEREIGN territories of the United Kingdom in Cyprus and Gibraltar) and nine annexes. The text of the negotiated withdrawal agreement and the political declaration on the framework for future EU-UK relations were approved by EU heads of state and government at a specially convened European Council on 25 November 2018. b) any guidance or other publication by the European Commission on how it will carry out these tasks. The UK`s official withdrawal from the EU came into force on 31 January 2020 (withdrawal date) at 11pm. On that date, the withdrawal period under Article 50 of the TUE ended and the ratified withdrawal agreement, which sets out the legal conditions for the UK`s withdrawal, came into force. The ratified withdrawal agreement was published in the Official Journal of the European Union on the day of the withdrawal, as well as the political statement on the framework of the future relations between the UK and the EU: both the draft withdrawal agreement and the political declaration have a significant impact on the UK Constitution.
